QUESTION 3: REGARDING THE REGULATION OF THE MINIMUM WAGE GAP

In the payroll policy, we want to evaluate a flexible way according to the results of the employees. However, Article 7.2 of Decree 49/2013/NĐ-CP requires dividing into different wage levels with the minimum wage gap of 5%, so we can not evaluate a flexible way according to the results . We look forward to having HCM City require MOLISA amend the Article 7.2 of Decree 49/2013/NDĐ-CP and withdraw regulation of the degree of differences between the level of wages above 5%. Due to minimum wage increased so much that Vietnam's labor market is losing appeal, we are considering closing or withdrawing factories from Vietnam. We look forward to having HCM City make request to MOLISA to not raise the minimum wage too high for example the rate of salary increase above 10%

According to Clause 2, Article 7 of Decree No. 49/2013/NĐ-CP dated 14/05/2013 of the Government, Department of Labor, War Invalids and Social Affairs has no authority to decide law amendments because this is the Decree of the government. We suggest Trade and Investment Promotion Center report to the People's Committee of the city and the Government Office.
