QUESTION 10: REGISTRATION FOR CONDUCTING PROMOTIONAL ACTIVITIES

Legally, it is necessary to register in advance for conducting promotional activities, but this affects the promotional activities which should be held promptly and positively. At the Roundtable with HCMC People's Committee in 2013, the Department of Industry and Trade said that "At present, the procedures related to registration / notification for conducting sales promotion activities of the business and the management of the Government for this issue shall be implemented according to the provisions Decree No.37/2006/NĐ-CP-dated 04/04/ 2006 of the Government and Circular No.7/2007/TTLT-BTM-BTC of the Ministry of Commerce and Ministry of Finance-dated 06/06/2007 guiding the content related to sales promotion, trade fair and exhibitions. Accordingly, enterprises must carry out registration procedures/inform with state authorities 7 working days prior to the beginning day of sales promotion activities. This regulation is to ensure the management function of the government as well as smooth management in this area, and is the legal basis for business to register for corporate tax deduction with related agencies. Moreover, at present, the Department also support business by shortening procedures for promotion activities by developing online software for registration / notification of sales promotion activities (expected to commence in 2014) ". Please tell us about the progress of the process developing software for registration / online notification expected to commence in 2014, how does it now?

The key group of procedures regarding registration / notification of sales promotion is regulated by Decree No.37/2007/NĐ-CP and Joint Circular No.07/2007/TTLT-BTM-BTC. The normal way is to send directly to the Department of Trade and Industry or send by post 7 days before doing promotion activities.

To assist businesses reducing the time and cost of implementing administrative procedures; and to serve state management activities, introduce promotional content as well as provide official information about the deals in the City, Department of Trade and Industry has developed electronic website serving Promotion events (www.khuyenmaihcmc.vn); which integrates registration / notification of sales promotion with online submission. Currently the website is being updated and upgraded by the Department so that it could be put into operation in the fourth quarter of 2014. During this time, business unit doing the registration / notification procedure may send records to the Department of Trade and Industry through email address sct@tphcm.gov.vn
